LRPROA Road Rules and Regulations Agreement
1. ROAD PURPOSE: The purposes of the Lower Rambla Pacifico Road Owners Association (LRPROA) gated road are to provide an escape route during emergencies, access for emergency vehicles and regular access for Members.
2. MEMBERSHIP: Members are limited to those owning a single-family residence (including those with guest houses) within the membership area designated by the Board of Directors from time to time, and who have purchased a membership. Memberships may be suspended or terminated in accordance with the LRPROA Bylaws. (Commercial enterprises of any type are not allowed to use the road.)
3. INSURANCE REQUIREMENTS: In order to use the road, the LRPROA requires all vehicles registered to members and anyone residing in a member’s household, and their tenants, to maintain the following minimum insurance for their vehicles: $100,000 for property damage and
$500,000 for bodily injury. The LRPROA may request proof of such insurance at any time, and the member is required to provide such proof within 24 hours of demand therefor.
4. PERMITTED VEHICLE REQUIREMENTS: The road is limited to insured personal vehicles not exceeding two axels, 4 tires, or approximately 12,000 GVW (a large SUV).
5. PROHIBITED VEHICLES: Except in emergencies, the following vehicles are prohibited from using the road: (1) uninsured vehicles; (2) large vehicles that exceed the limits in Paragraph 4 above, including, without limitation: campers and recreational vehicles; (3) commercial and service vehicles for plumbers, construction, delivery businesses, repairmen, gardeners and other “outdoor” employees and contractors. Also prohibited are most trailers: including commercial trailers of any type; horse trailers; trailers exceeding 750 pounds total weight; trailers not equipped with functioning breaks; trailers exceeding tow rating for the towing vehicle; and trailers too long to remain in the proper traffic lane. NOTE: Members with permitted trailers must contact the LRPROA management company for prior road use authorization. Non- members are not allowed to tow trailers on the road.
6. NOISY VEHICLES: Unreasonably loud vehicles are disturbing to homeowners in the vicinity of the road, and sound is amplified and carried through some of the canyons. Therefore, vehicles that are unreasonably loud or because they have high performance engines or are unreasonably loud for other reasons should be operated in a manner that minimizes the noise to the extent practicable. Vehicles with excessive noise due to lack of maintenance or due to muffler modifications are not permitted to use the road in a manner that disturbs homeowners. Note: Driving within the 25 MPH speed limit may limit the noise from vehicles with engines or exhaust systems that are particularly loud at higher RPMs. If the LRPROA receives complaints about noise from particular vehicles in violation of these rules, it may take action to enforce this rule against the Member with whom that vehicle is associated.
7. LIMITED ROAD ACCESS: Except in emergency situations where there is a threat to persons or property, Members shall not allow access to resident non-members (i.e. those who could have but declined to join the Association). This includes any guests or employees of non-members and car pools where a resident non-member is the driver. Note: In addition, Members may NOT buzz through the gates any prohibited vehicles as listed in Paragraph 5.
8. ENTRY DEVICES – BAR CODES
a) Bar codes must be permanently affixed to the vehicle (except for cloth topped jeeps
b) Members are limited to no more than 10 entry devices.
c) Entry devices may not be copied or duplicated
d) Renters who reside at a Member’s address and whose vehicles are registered to that address, and regular household employees, such as housekeepers, nannies or short-term house guests may qualify for an entry device if they meet the terms set forth in Paragraphs 3 and 4 above. Longer-term employees and guests should obtain a bar code. Clickers may be lent to short- term houseguests or temporary household employees only (such as care-givers). These are primarily for the use of the member only. There is a limit of 2 clickers per household.
e) Except as provided above, members shall not give or lend entry devices to anyone including non-member residents, outside workers, repairmen or contractors. (Call boxes permit guests to call the Member, who can then open the gate remotely.)
f) Prior to the Member or person receiving the entry device he/she shall provide a copy of his/her driver’s license, registration, and proof of insurance for each vehicle.
g) From time to time the Board may check to confirm that a vehicle’s entry device has been approved as per the requirements above.
9. Speeding: The maximum speed limit on the road is 25 mph. Those who grossly exceed the speed limit on the road or its approaches shall be deactivated for one week for the first violation.
10. Drunk Driving: Anyone involved in an accident while intoxicated, shall be deactivated and shall not drive on the road for one month.
11. Use of Road While Deactivated: Any Member who uses the road during a deactivation period shall have all devices associated with that address deactivated for one additional month and face a one thousand dollar ($1,000) fine, which must be paid prior to reactivation.
12. Lending Clickers: The lending of clickers by a Member to non-member residents, outside workers, repairmen or contractors is strictly prohibited and will result in a one hundred dollar ($100.00) fine and a deactivation of at least one week for all devices connected to that address.
13. RULE VIOLATION PENALTIES: For any violation of these Rules or the Bylaws, the Member’s road access may be suspended and/or the LRPROA may levy fines against the Member. In addition to the penalties specifically identified above, for any other violations, the minimum fine is two hundred and fifty dollars ($250.00) and may be up to one thousand dollars ($1,000.00) per violation, in the Board’s discretion.
Suspension of a Member’s road access shall be for periods of time reasonably determined by the Board of Directors in accordance with the Bylaws. Repeat and subsequent violations may lead to increasingly longer periods of suspension, or termination of membership in accordance with the Bylaws. The suspension of road access may apply to all bar codes and clickers issued for the Membership. There will be a reactivation fee of twenty-five dollars ($25.00) per bar code and clicker.
14. ROAD DAMAGE. The Member is responsible for any and all damage to the Road caused by the Member and/or the Member’s family members.

15. REIMBURSEMENT OF LEGAL COSTS: In any action to enforce these Rules or the Bylaws of the LRPROA, the LRPROA shall be entitled to recover all attorneys’ fees and costs incurred by it and to charge same as an Assessment against the Member’s account.
16. RULES SUBJECT TO CHANGE: All rules are subject to change by vote of the LRPROA Board.
17. SAFETY FIRST: While using the road, be aware of possible unsafe situations including, people using the pedestrian easement, deer on the road, weather conditions that might inhibit gate function, or afternoon sunlight impairing vision. Extreme caution is advised at all times.
